Microsoft/Google Suit Update
Earlier today, U.S. District Court Judge Ronald Whyte issued a stay on the Google suit against Microsoft over the hiring of former Microsoft executive Dr. Kai Fu Lee. Whyte put the tentative decision on the web last night and met with Google and Microsoft today in court.
A Microsoft spokesperson commented on the decision, "We are pleased and encouraged by Judge Whyte's tentative order granting Microsoft's motion to stay. If entered, this order will allow our case to proceed in Washington where the court has already ruled twice in our favor. We look forward to presenting our case at trial in January."
The Google case was a countersuit filed in the northern district of California in San Jose against Microsoft's legal action filed in Washington. All this surrounds the departure of former Microsoft executive vice president Dr. Kai Fu Lee. Lee approached Google for a job, offering to help Google develop the Chinese division of their business. According to Microsoft this is what he did for them.
The suit is scheduled to resume in January when it goes to trial. Based on today's decision, all further legal action will be in Washington, where Microsoft is based and no-compete contracts could hold up.
At the time of the story, Google had yet to respond.
