Apple Gets Court Nod In Tiger Case
A Florida District Court judge decided in favor of Steve Jobs' computer maker in its trademark dispute.
Tiger Direct received a setback in its court case against Apple Computer. Tiger Direct had sued to request an injunction against Apple's distribution of its "Tiger" update to OS X. Tiger Direct later modified the suit to limit Apple to only using the Tiger name in conjunction with OS X or OS 10.4.
In the suit, Tiger Direct claimed the name choice by Apple was confusing customers and diluting Tiger Direct's search engine placement results. A judgment in favor of Tiger Direct would have removed Apple's release from store shelves everywhere.
The sitting judge, Joan Lenard of the Southern Florida District Court, decided an injunction would hurt Apple more than any potential harm Tiger Direct would experience. Judge Lenard ruled on the case a week ago, but the decision was just recently released.
In her 56-page brief, Judge Lenard failed to find any cause to believe consumers would be confused by the name. Apple lawyers further contended that it had prior history of using names of big cats for its operating system releases.
Judge Lenard concluded the brief by noting customers who cross-shop at the two online stores or in retail stores "will be able to distinguish their respective retail outlets due to the distinctive differences in their marketplaces' appearance and messages."
