Eminem Takes A Bite Out Of Apple
The Detroit rapper's music label settles with the Cupertino-based computer firm over a tiny bit of copyright infringement.
The story drips with irony. Apple Computer, notorious for its hyper-aggressive stance when it feels its intellectual property has been leaked online or otherwise abused, used the song "Lose Yourself" without permission from Eminem's publisher.
Mr. Jobs recently made news when Apple removed publications by John Wiley and Sons from the shelves of all of its stores, in response to the pending publication of an unauthorized biography about the CEO.
Apple's advertisement featured a person singing the rapper's song in a commercial promoting iTunes and the iPod music player. The commercial aired on Viacom's MTV network and ran for about three months.
A complaint filed by Eight Mile Style in response to the commercial claimed Apple, MTV, and ad agency Chiat/Day had no right to use the song. Damages sought by Eminem were reportedly $10 million USD.
Apple CEO Steve Jobs attempted to negotiate some sort of compensation for using "Lose Yourself," in a call to Eight Mile Style's manager Joel Martin. The call took place while the commercial was in production, according to the Detroit Free Press, and Mr. Jobs stated, "Apple was too far into its original campaign to make any changes."
Terms of the settlement between the two parties were not disclosed. Attorneys involved with the negotiations called the settlement "amicable."
